Mr. VAN HOLLEN (for himself and Mr. DENT) submitted the following concurrent resolution; which was referred to the Committee on Oversight and Government Reform
CONCURRENT RESOLUTION

Honoring professional surveyors and recognizing their contributions to society.

 Whereas there are over 45,000 professional surveyors in the United States;

 Whereas the nature of surveying has changed dramatically since 1785, as it is no longer limited to the description and location of land boundaries;

 Whereas hydrographic surveys are important to the use of all bodies of water;

 Whereas engineering surveys are utilized in the study and selection of engineering construction;

 Whereas geodetic surveys determine precise global positioning for such activities as aircraft and missile navigation;

 Whereas cartographic surveys are used for mapping and charting, as well as photogrammetry, the science of using aerial photographs for measurement and map production;

 Whereas many services are provided through the use of sophisticated surveying equipment and techniques, including satellite-borne remote sensing devices and automated positioning, measuring, recording, and plotting equipment;

 Whereas the role of the surveyor has been, and remains, of vital importance in the development of the United States;

 Whereas since the colonial days of this Nation, surveyors have been leaders in the community, Statesmen, influential citizens, and shapers of cultural standards;

 Whereas former surveyors include George Washington, Thomas Jefferson, and Abraham Lincoln;

 Whereas it was the work of the surveyor that determined the boundaries of land, the greatest economic asset in the colonies that became the United States;

 Whereas Thomas Jefferson chaired a committee in 1784 to devise a plan for disposing of lands west of the 13 original colonies;

 Whereas Thomas Jefferson argued that surveying before sale was necessary to prevent overlapping claim and to simplify deeds and registers;

 Whereas Thomas Jefferson reportedly wrote a plan, which was debated in Congress and in modified form was adopted as the Land Ordinance of May 20, 1785, establishing the Public Land Survey System (`PLSS'), the rectangular system that continues today in 30 midwestern and western States; and

 Whereas the establishment of the third week of March as `National Surveyors Week' would be a fitting tribute to all surveyors: Now, therefore, be it

 Resolved by the House of Representatives (the Senate concurring), That Congress--

 (1) supports the establishment of National Surveyors Week;

 (2) requests that the President issue a proclamation calling on the people of the United States to observe National Surveyors Week each year with appropriate ceremonies and activities paying tribute to professional surveyors and their contribution to society; and

 (3) invites the people of the United States to look back at the historic contributions of surveying and look ahead to the new technologies which are constantly modernizing this honored and learned profession.

Petition 07-09 The Wisconsin Bar is requesting the State Supreme Court approve a definition for the practice of law.  The Supreme Court held a public hearing on the issue. 
WSLS provided written testimony in opposition to the petition.
The Supreme Court will discuss the matter at its open administrative conference on March 14, 2008 at 9:30 in the Supreme Court room.  WSLS received a letter from the Supreme Court noting that the State Bar has proposed and exception in the proposed rule which would exempt persons "Practicing within the scope of practice allowed by a current credential issued under Wis. Stats. Chs 440 to 480 provided that the Supreme Court has not determined by rule or by published opinion that the activity constitutes the unlicensed or unauthorized practice of law.".

 The court entertained the idea of exempting those governed under 440-480 and those governed by DRL.  They realized this was far too broad, and didn’t want acupuncturists exempted from giving legal advice.  Thanks to the WSLS and WSPE correspondence, they did say that surveyors & engineers should be exempted but NOT staff working under the supervision of the licensed professional.  This doesn’t make much sense to me, because they are exempting all staff working under attorneys.  Jack Zweig from DRL was asked to speak, be sure to listen to his comments.

They are putting their revisions on paper, and plan another round table discussion in the near future to continue on this topic.  Look for a letter to come to WSLS with the changes discussed today."

WSLS Modernization proposal

Discussions are going on to get an understanding between the parties involved and discussions with key legislators who are  potential sponsors of the proposal.

 
Electronic recording of surveys The Committee has met with the Wisconsin Register of Deeds Association and discussed some of the issues.   The Committee is crafting some preliminary language bases on the the discussions to date.  The language will be shared with all interested parties.  Please contact Frank ThousandThe draft will be posted as soon as it is ready.

Continuing Education rules The Committee is working on a draft for a continuing education program for surveyors. 2007 Wisconsin Act 47 makes it possible for the Land Surveyors Section to create Administrative rules to govern a Continuing Education program in Wisconsin.    The draft includes language from the WSLS Voluntary program and combines parts of the laws from other states.  The draft will be posted as soon as it is ready.
